How buying a new build in Marbella works

The first sale of a new home pays VAT (IVA) at 10% of the price and, on the deed (escritura) signed before a notary, stamp duty (AJD) at the regional rate (Andalucía): 1.2%. A resale home pays transfer tax (ITP) instead. Notary, Land Registry and any mortgage come on top. The usual order is a reservation, a private contract with stage payments during construction, and the deed when you get the keys. Before you pay, ask the developer in writing for the bank guarantee or insurance covering those payments: the law requires it.

Law: VAT – IVA (new home, first sale) — Ley 37/1992 IVA, art. 91.Uno.1.7º; AJD stamp duty (new home purchase) — Ley 5/2021 Tributos Cedidos Andalucía, art. 49. Checked: 15/10/2026.
