Spanish inheritance and gift tax for non-residents: reliefs by region
This table shows, region by region, what tax relief a non-resident of Spain gets when inheriting from, or receiving a gift from, close family: groups I and II, that is children and other descendants, spouses, parents and other ascendants. For each autonomous community we give the relief its own law sets (a reduction of the tax due, a deduction, an allowance against the taxable base or a reduced rate), with the conditions, the law, the article and the date we checked it.
Non-residents are no longer confined to the state scale. On 3 September 2014 the EU Court of Justice ruled (case C-127/12) that taxing residents and non-residents differently breached the free movement of capital. From 1 January 2015 Law 26/2014 let residents of the EU and EEA apply the regional rules. In 2018 the Spanish Supreme Court (judgment 242/2018), ruling on a claim for damages against the state, recognised that the unequal treatment also breached EU law for residents of non-EU countries; since 11 July 2021 Law 11/2021 gives that right to every non-resident, wherever they live. Navarra and the Basque Country levy their own (foral) tax.
What matters is not where the heir lives. For an inheritance it is the region where the deceased lived, if they lived in Spain; if not, the region holding most of the value of their assets in Spain. For a gift of a home or other real estate it is the region where the property is; for a gift of money, the region where the money was held longest before the gift. In many regions, including Andalucía, the Comunitat Valenciana, the Región de Murcia and the Illes Balears, inheritance tax for children and spouses is cut almost to nothing, provided the conditions in the row are met.

How the table is compiled
Every row comes from the law in force in the region or the state, read in its consolidated text in the BOE (Spain's official gazette) or in the regional gazette, and two independent reviews have checked it separately. Each figure carries the law, the article, a link to the text and the date checked. Consolidated texts can lag behind the latest regional laws: where the most recent amendment has not been confirmed in the regional gazette, the row is marked ≈, shown without a figure as "awaiting check", and we do not treat it as settled until it is verified.
- Relief is not exemption. Even with full relief you must file a self-assessment return with the Spanish Tax Agency (AEAT), which handles the tax for non-residents. For an inheritance the deadline runs from the date of death and can be extended once if you ask in time; for a gift it is counted in working days from the date of the gift and cannot be extended. The exact deadlines, with the article of the tax regulations, are in the general rules.
- Filing late can cost you the relief. In several regions the relief only covers what is declared on time or, at the latest, before the tax authority sends a formal request.
- Gifts. In almost every region the relief on a gift depends on a notarial deed, and for gifts of money many regions require the deed to state where the funds came from. For money and other movable assets, the region that applies is the one where they were held for the most days during the look-back period set by law; this too is in the general rules.
- Reliefs differ. In some regions the relief depends on the relationship and age, shrinks as the inheritance grows, or a gift is taxed at a reduced rate instead of getting a reduction of the tax due. Each region's row shows which case applies.
- Foral regimes. In Navarra and the Basque Country the tax is levied by the foral treasury when the deceased lived there, the donated property is there or, for a non-resident, most of the assets are there. Foral rates are not included in this table. Ceuta and Melilla apply the state rules.
- Tax paid in another country. Spain does not credit non-residents for tax paid abroad: the international double taxation deduction (Law 29/1987, art. 23.1) is only available to those taxed on a personal (resident) basis. Your country of residence may also tax the inheritance or gift; whether it takes the Spanish tax into account is a matter for its own rules.
The table describes the law and is not advice on any particular case.

Terms of use
The selection of laws, the table and the CSV are our own compilation at flatin.es, based on the BOE and the regional official gazettes. You may use them with a link to flatin.es; we recommend linking to this page. Each CSV row carries the credit in the source column, together with the law and the check date. The laws themselves are official texts; the selection and the summaries are ours and may go out of date if a region changes its law after the date shown.
